Purpose and acceptance

These terms govern the use of Kiai, a platform for organising fighting-game tournaments available at kiai.gg and through its Discord bot.

Creating an account requires their express acceptance, collected at first sign-in. Without that acceptance, no account is created.

They apply together with the privacy policy, which forms an integral part of them.

Access to the service

Access requires a valid Discord account. Kiai manages no passwords: authentication is delegated to Discord. A Discord account may be linked to only one Kiai account.

The service is restricted to persons aged at least fifteen. By creating an account you declare that you have reached that age. No verification is carried out beyond that declaration; any account reported as belonging to a younger person will be deleted.

You are responsible for the use made of your account. If your Discord account is compromised, it is for you to inform Kiai at kiai.fgc@gmail.com.

Free of charge

Kiai is provided free of charge. No subscription, no access fee and no commission is levied, either on players or on organisers.

Any change to the business model would give rise to a new version of these terms, to separate terms of sale, and to the prior collection of your agreement. No feature that is free today will become chargeable without prior notice to you.

Kiai is a tool, not the organiser

The organiser is solely responsible for their tournament: for its rules, for its compliance with the regulations applicable to video game competitions, for respecting the rights attached to the games concerned, for the conduct of matches, for handling sporting disputes and for the behaviour of their community.

Where a tournament displays an entry fee or a prize pool, that information is entered freely by the organiser and displayed as such. Kiai collects no entry fee, holds no funds, pays out no prize and takes no part at any point in the financial flows between players and the organiser. The legal and reporting obligations attached to organising a prize competition fall on the organiser.

Kiai is not a party to any dispute concerning the payment of an entry fee or the award of a prize. Such disputes are settled between the player and the organiser.

Your undertakings

In using Kiai, you undertake to:

  • Provide accurate information, and in particular a username that is neither abusive, nor discriminatory, nor liable to impersonate a third party
  • Report your match results truthfully
  • Not create a secondary account in order to distort a standing, a placement or a belt progression
  • Not disrupt the running of a tournament, nor the technical operation of the service
  • Respect other participants, organisers and broadcasters
  • Comply with the rules specific to each tournament you enter

Deliberately reporting a false result, manipulating a standing and harassing a participant are serious breaches.

Content published by organisers

Organisers may publish content: tournament names and descriptions, artwork, banners. They retain ownership of it.

By publishing content, the organiser warrants that they hold all rights necessary for its distribution, and in particular the authorisations relating to artwork, trademarks and graphic elements taken from the games concerned. They indemnify Kiai against any third-party claim founded on that content.

The organiser grants Kiai a non-exclusive, royalty-free licence, limited to the duration of publication, for the sole purpose of hosting and displaying that content on the service.

Kiai reserves the right to remove without notice any content that is manifestly illicit or contrary to these terms.

Results and competition data

Your match results, your placements and your belt progression concern you and belong to you. Kiai claims no ownership over them.

You grant Kiai a non-exclusive, worldwide, royalty-free licence to host, reproduce and display those results, your username and your belt on the public surfaces of the service — brackets, standings, tournament pages and profiles — as well as in the video broadcasts of the tournaments you take part in. That licence is the very condition of running a public competition.

Kiai reserves the right to exploit aggregated and anonymised statistics, built so as to permit the identification of no player, in particular to improve the service, to produce collective standings and for public communication.

If your account is deleted, your results are retained under an anonymous identity, under the conditions set out in the privacy policy.

Moderation and sanctions

Organisers have moderation tools over their own tournaments: excluding a participant, annotating a case file, resolving a score dispute.

In the event of a serious or repeated breach of these terms, Kiai may restrict access to certain features or suspend the account concerned. A suspension is notified to you and you may contest it at kiai.fgc@gmail.com.

Where a score is disputed, the match is frozen and handed to the organiser. No contested result is arbitrated automatically.

Reporting illicit content

Any manifestly illicit content hosted on the service may be reported to kiai.fgc@gmail.com. Please state the exact address of the page concerned, the nature of the content and the grounds for the report.

Kiai undertakes to examine every report and to remove manifestly illicit content promptly.

Availability and liability

Kiai endeavours to ensure continuity of service but guarantees no uninterrupted availability. Interruptions may occur for maintenance, technical incident, or unavailability of a third-party service on which Kiai depends — Discord in particular.

The service being provided free of charge, Kiai’s liability can be engaged only in case of fault and within the limits permitted by applicable law. It cannot cover the consequences of a badly run tournament, of a dispute between a player and an organiser, or of the loss of a chance of winning.

No clause of these terms limits Kiai’s liability in the event of personal injury, gross negligence or wilful misconduct.

Termination

You may delete your account at any time from your profile, without reason and without notice. The effects of that deletion on your data are described in the privacy policy.

Kiai may terminate your access in the event of a serious breach of these terms, or if the service is discontinued. In the latter case, reasonable notice is given and an opportunity to retrieve your data is offered.

Changes to these terms

These terms carry a version number and an effective date. Every published version remains available: a revision is added alongside the previous ones rather than replacing them.

Any substantial change will be presented to you at your next sign-in and your acceptance will be collected again. Continuing to use the service without accepting is not possible.

Governing law and disputes

These terms are governed by French law.

In the event of a dispute, an amicable solution will be sought first, by writing to kiai.fgc@gmail.com. Failing agreement, the French courts have jurisdiction. If you are a consumer, you may use a consumer mediator free of charge and retain the right to bring proceedings before the court of your place of residence.
